ESIC Tamil Nadu Advocate Recruitment Eligibility Criteria

The eligibility criteria prescribed under Annexure-A of the notice are as follows:

  • The advocate must hold at least a Bachelor's Degree in Law from a recognized University in India.
  • The advocate must be enrolled/registered with the Bar Council of India / State Bar Council and must be in active practice at the Bar.
  • Minimum 10 years of professional experience is required for empanelment before the Hon'ble High Courts in Tamil Nadu and the Hon'ble CAT, Chennai Bench.
  • Minimum 5 years of professional experience is required for empanelment before district-level courts and other forums.
  • Applicants should have regular practice and standing at the Bar, and preferably experience handling labour-law-related cases, supported by necessary documents/judgments.
  • Applicants must be well versed in the Code on Social Security, 2020 (which subsumes the erstwhile ESI Act, 1948), labour law, and Civil and Criminal procedure, along with other relevant Acts and Codes.
  • Applicants should have a sound professional reputation, good communication skills, and adequate office infrastructure (chamber, staff, communication facilities) at the city/town where the court is located.
  • Advocates are required to have an office at the place where empanelment is sought.

The Competent Authority may relax the experience criteria or prescribe additional qualifications or conditions as deemed fit.

Disqualification Criteria

As per the notice, an advocate may be treated as ineligible for empanelment if:

  • A disciplinary proceeding is pending, or an adverse order has been passed by the Bar Council affecting professional conduct.
  • A criminal case involving moral turpitude is pending, or a conviction has been recorded.
  • The advocate has suppressed material facts or submitted false information.
  • There is an actual or potential conflict of interest with ESIC.
  • The advocate's past performance with ESIC is found unsatisfactory.
